Terms of Use
1. Who these terms are between
These terms are an agreement between you and Terrazed ("we", "us"), the operator of terrazed.io. By creating an account or using the service you accept them. If you do not accept them, do not use the service.
2. What Terrazed does
Terrazed generates terrain heightmaps and related map data for use in game engines and 3D tools. It can build terrain procedurally, or from real-world elevation, imagery and map data retrieved from third-party services.
3. Third-party data: the important part
Terrazed retrieves elevation, imagery and map data from services operated by other organisations. We do not own that data and cannot grant you rights to it. Each source sets its own licence, and by using Terrazed to retrieve it you agree to comply with that licence yourself.
Every source, and what its licence permits, is listed on the data sources page, and shown in the interface before you download anything. Two points deserve emphasis:
- Some sources are non-commercial only or restrict redistribution. Using them in a commercial or publicly released project may breach their terms even though Terrazed let you download the file.
- Most sources require attribution. Export bundles include a manifest with the required credit text for the sources actually used.
You are responsible for checking the licence of the data you use and for complying with it. We are not responsible for your use of third-party data. Nothing Terrazed does, including allowing a download, should be read as permission from the data owner.
You must not use Terrazed to place unreasonable load on those upstream services, to circumvent their rate limits, or in any way that breaches their own terms of use.
4. Accounts
You need an account to save projects and to buy the full version. Give an accurate email address, keep your password to yourself, and tell us promptly if you believe your account has been accessed by someone else. You are responsible for what happens under your account.
You must be old enough to form a binding contract where you live.
5. Payment
- Terrazed has a free plan and a paid full version. What each includes is shown in the app and may change.
- The full version is a one-time purchase. There is no subscription, nothing renews, and there is nothing to cancel.
- Payments are processed by Stripe. We never see or store your card details.
- What you buy is access to the full version on your account for as long as Terrazed runs. It is not a licence to redistribute Terrazed itself.
- Prices may change. A change never affects a purchase already made.
- If you are a consumer in a jurisdiction that gives you a statutory right to cancel a digital purchase, that right applies and is unaffected by anything here.
- Otherwise payments are non-refundable, though if something has genuinely gone wrong, contact us. We would rather sort it out than argue.
- A refunded or charged-back payment removes access to the full version. The free plan and your saved projects are unaffected.
6. Your content
Terrain you generate, settings you choose and projects you save remain yours. We claim no ownership of them. We store them only to provide the service: to show them back to you, to sync them between your devices, and in backups.
Note that ownership of your work does not extend to the third-party data underneath it. A heightmap derived from someone else's elevation data still carries that data's licence.
7. Acceptable use
You agree not to:
- break the law, or use Terrazed to help anyone else do so;
- attempt to gain access to accounts, systems or data that are not yours;
- interfere with the service, or place deliberate excessive load on it;
- work around usage limits, plan restrictions or rate limits;
- resell or redistribute access to Terrazed itself without our written agreement.
8. Availability
Terrazed is provided as it is, with no guaranteed uptime. It depends on third-party services that can be slow, rate-limited or unavailable, and features can be disabled at short notice if they are causing problems. During beta this happens more than it will later.
9. Disclaimers
To the fullest extent the law allows, Terrazed is provided "as is" and "as available", with no warranties of any kind, express or implied.
In particular, we make no warranty about the accuracy of elevation, imagery or map data. It comes from third parties, is resampled and processed, and is intended for creative and game-development use. Do not use output from Terrazed for navigation, engineering, surveying, flood or hazard assessment, or any purpose where inaccuracy could cause harm or loss.
10. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data, or loss arising from your use of third-party data. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.
Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence, and for fraud. If you are a consumer in Australia, the consumer guarantees under the Australian Consumer Law apply and cannot be excluded; nothing in these terms limits them. Consumers elsewhere keep their own statutory rights.
11. Suspension and termination
You may stop using Terrazed and delete your account at any time. We may suspend or close an account that breaches these terms, or where required by law. If we close your account without cause while you have paid for a period, we will refund the unused part.
12. Changes to these terms
We may update these terms. If a change materially affects your rights we will tell account holders by email or in the app before it takes effect. Continuing to use Terrazed after that means you accept the change.
13. Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Melbourne, Victoria have exclusive jurisdiction, except where consumer protection law in the country you live in gives you the right to bring a claim locally.
